Why this is the answer

The Constitution does not fix the number of Supreme Court justices; Congress sets it by law. The number has been nine since 1869, but because it is set by law, USCIS asks you to check uscis.gov/citizenship/testupdates and give the number that is current on your interview day. The justices are one Chief Justice plus the Associate Justices.
